The ShopStyle & LUISAVIAROMA From Italy With Love Giveaway (the “Giveaway”) for a chance to win a € 3,000 gift card to spend online at LUISAVIAROMA is sponsored by Sugar Publishing Inc. (owner and operator of shopstyle.de), having an address of 111 Sutter Street, Suite 850, San Francisco, CA 94104 and LUISAVIAROMA SpA, (owner and operator of luisaviaroma.com), having an address of Via Scipione Ammirato, 100 – 50136, Florence, Italy (collectively, “Sponsor”). Entrant’s registration and participation in the Giveaway shall be governed by the terms and conditions contained herein (the “Official Giveaway Rules”).
ELIGIBILITY:
The Giveaway is open only to legal residents of Germany. All entrants must be at least eighteen (18) years of age as of the date of entry. Employees of Sponsor and each of their respective parents, affiliates, subsidiaries, and advertising and promotion agencies and any other entity involved in the development or administration of this Giveaway, and their immediate family members (defined as spouses and biological, adoptive or step-parents, legal guardians, children, siblings, or grandparents, their respective spouses and any dependent under federal income tax law) or household members are not eligible to participate in or win the Giveaway. Winners may be required to sign an Affidavit of Eligibility, Release of Liability, and complete any relevant tax forms as a condition to the delivery of the applicable prize. HOW TO ENTER: No purchase is necessary to participate in the Giveaway. Beginning at 12:00am CET on November 8, 2012 and ending 12:00am CET on November 23, 2012 (the “Entry Period”), visit http://www.shopstyle.de/giveaway Giveaway and follow the on-screen instructions to register for a chance to win and be automatically entered in the Giveaway.
Alternative Method of Entry (AMOE): You may also enter the Giveaway by mail as follows: on a plain 3” x 5” index card, legibly handprint or type your first name, last name, date of birth, complete address, city, state, zip code, home phone number (including area code), and email address (if any) and mail your completed 3” x 5” card to: “From Italy With Love Giveaway” Sugar Inc. UK Limited, Unit 107, 111 Power Road, London W4 5PY. To be considered eligible in the Giveaway, and, in order to be deemed to have been received during the Entry Period, AMOE entries must be postmarked no later than Friday, November 23, 2012 and received no later than 12:00 pm CET on Monday, November 26, 2012. Regardless of the method of entry, only one (1) entry per person is permitted.
Any entries received after the Entry Period will not be eligible. If more than one entry is received per person, only the first such entry received will be eligible. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email account will be deemed to be the entrant. “Authorized account holder” of an e-mail address is the natural person in whose name the e-mail address has been issued. A selected winner may be asked to provide Sponsor with proof that the selected winner is the authorized account holder of the e-mail address associated with the winning entry. If a dispute cannot be resolved, the entry will be deemed ineligible. Use of automated devices not valid for entry.
Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. All entries become the property of the Sponsor. Entries generated by script, macro or other automated means are void. Any personal data collected by Sponsor from entrants will not be disclosed to a third party without the entrant’s consent. However, by registering for participation in the Giveaway you hereby give your express consent for the email address you provide in connection with registration to be used by Sponsor for email marketing communications from Sponsor only. By submitting personal data, entrants understand and agree that this data may be transferred outside the European Union (“EU”) and may be stored and processed by Sponsor and its agents in any of the countries in which each Sponsor maintains offices, including the United States and Italy. PRIZE: At the end of the Entry Period, there will be one (1) drawing in which one (1) potential grand prize winner shall be selected at random by Sponsor from all eligible entries received during the Entry Period. One (1) winner will win a €3000 (EUR) LUISAVIAROMA gift card to spend online at http://www.luisaviaroma.com/ (total prize value € 3,000 (EUR)) (the “Grand Prize” or “prize”). If the potential Grand Prize winner forfeits or does not claim the Grand Prize, it will be re-awarded, in Sponsor’s sole discretion. Other restrictions may apply. Decisions of the Sponsor are final and binding with respect to all matters related to the Giveaway. All prizes will be awarded. In no event shall the Sponsor be obligated to award more prizes than the number of prizes stated in these Official Giveaway Rules. No substitution or transfer of the Grand Prize by winner is permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that the advertised prize becomes unavailable. The Grand Prize winner shall be solely responsible and liable for all federal, state and local taxes on the value of their prize. SELECTION: The winning entry will be chosen at random from among all eligible entries received. The number of eligible entries received determines the odds of winning. The Giveaway will be conducted under the supervision of the Sponsor. In the event of a dispute regarding the identity of the person submitting the entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. The decisions of the Sponsor are final and binding in all matters relating to this Giveaway. Sponsor reserves the right to change the method of notification with any such changes to be posted on the Giveaway landing page at http://www.shopstyle.com/Giveaway. The Grand Prize winner will be notified by Sponsor by email and must claim their prize within seventy-two (72) hours after the date of notification of such prize. A Giveaway winner's failure to respond to the prize notification within the specified seventy-two (72) hours will be considered such Giveaway winner's forfeiture of the prize and an alternate winner may be selected from the pool of eligible entries. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries. GENERAL CONDITIONS AND RELEASES: An entrant or winner may be disqualified from the Giveaway if he or she fails to comply with each provision of these Official Giveaway Rules, as determined in the sole discretion of the Sponsor. Participation in the Giveaway is at entrant’s own risk. By entering, an entrant agrees to release and hold harmless Releasees from any damage, injury, death, loss, claim, action, demand, or other liability (collectively, “Claims”) that may arise from their acceptance, possession and/or use of any prize or their participation in the Giveaway, or from any misuse or malfunction of any prize awarded, regardless of whether such Claims, or knowledge of the facts constituting such Claims, exist at the time of entry or arise at any time thereafter. Sponsor reserves the right, in their sole discretion, to cancel or suspend this Giveaway should viruses, bugs or other causes beyond their control corrupt the administration, security or proper play of the Giveaway. In the event of cancellation or suspension, Sponsor shall promptly post a notice on the Giveaway entry page to such effect. Any dispute arising from or relating to the subject matter of this Giveaway shall be finally settled by arbitration in San Francisco County, California, using the English language in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. (“JAMS”) then in effect, by one commercial arbitrator with substantial experience in resolving commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with the Streamlined Arbitration Rules and Procedures of JAMS. Judgment upon the award so rendered may be entered in a court having jurisdiction or application may be made to such court for judicial acceptance of any award and an order of enforcement, as the case may be. Notwithstanding the foregoing, each party shall have the right to institute an action in a court of proper jurisdiction for injunctive or other equitable relief pending a final decision by the arbitrator. For all purposes of this Giveaway, the parties consent to exclusive jurisdiction and venue in the United States Federal Courts located in the Northern District of California.
